As Arta Textile Industry and Trade Limited Company, in our capacity as the Data Controller, we would like to inform you about the protection and processing of your personal data in accordance with the Personal Data Protection Law numbered 6698 (“KVKK”), relevant legislation, and board decisions; within the framework of our obligation to inform, we want to provide information about which personal data of yours will be processed, for what purposes your personal data will be processed, to whom and for what purposes they may be transferred, collection methods and legal reasons, processing periods, the identity of the data controller, and your rights granted under the KVKK.

Data Controller: Real person or legal entity responsible for determining the purposes and means of processing personal data and establishing and managing the data recording system,

Data Processor: Real person or legal entity who processes personal data on behalf of the data controller based on the authority given by them,

Your personal data is processed by Arta Textile Industry and Trade Limited Company in accordance with the legal reasons provided in Article 5 of the KVKK, such as “explicitly stipulated in the laws, directly related to the establishment or performance of a contract, necessary for the data controller to fulfill its legal obligation, and necessary for the legitimate interests of the data controller” or based on the “explicit consent” of the data subject, for the following purposes: (i) Compliance with the law and principles of honesty, (ii) Accuracy and, when necessary, updating, (iii) Specific, clear, and legitimate purposes, (iv) Being related to the purpose of processing, limited and proportionate, and (v) Being kept for the period prescribed in the relevant legislation or for the period necessary for the purpose of processing; in a manner compliant with the relevant legislation and kept in the most accurate and up-to-date manner, as you have informed us or as it has been informed to us:

Arta Textile Industry and Trade Limited Company collects your personal data through verbal, written, electronic, or visual means such as contract, email, personal statement, guarantee letter, guarantee bond, guarantee check, check copy, promissory note copy, receipt copy, order form, invoice copy, and security cameras; and processes your personal data within the framework of the purposes listed above, based on your explicit consent or, in exceptional cases specified in the law, without your explicit consent according to Articles 5 and 6 of the KVKK. The exceptional cases our company is subject to are as follows:

Stipulated in the laws, Directly related to the establishment or performance of a contract, provided that the processing of personal data belonging to the parties of the contract is necessary, Necessary for the data controller to fulfill its legal obligation, Necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject, PROCESSING PERIOD OF YOUR PERSONAL DATA:

Your Personal Data will be processed in compliance with the legislation on the protection of personal data, board decisions, national and international agreements, and other legislation requiring mandatory periods, and will be processed for the purposes stated above as long as these purposes exist. For example; data related to customers is kept for 10 years from the termination of the contract according to the Turkish Code of Obligations and for 10 years from the date the document is issued according to the Turkish Commercial Code.

TRANSFER OF YOUR PERSONAL DATA TO THIRD PARTIES AND/OR ABROAD:

Your personal data will be shared with authorized institutions and organizations, banks, ministries, the Court of Accounts, service providers/suppliers, and Customs in cases stipulated as exceptions in the law, stated above, and for the purposes specified with your explicit consent only, without your explicit consent in other cases. The transfer of your personal data abroad is possible with your explicit consent.

ACCESS TO YOUR PERSONAL DATA AND YOUR RIGHTS UNDER KVKK:

Under Article 11 of the KVKK, you can apply to our company, Arta Textile Industry and Trade Limited Company, to:

Learn whether your Personal Data is being processed, Request information if your Personal Data has been processed, Learn the purpose of processing your Personal Data and whether they are used for the intended purpose, Know the third parties to whom your Personal Data is transferred domestically or abroad, Request correction if your Personal Data is incomplete or inaccurate, Request deletion or destruction of your Personal Data in accordance with the purpose, duration, and legitimacy principles of processing, and request notification of these actions to third parties to whom your Personal Data has been transferred, Object to a decision made against you based solely on automated processing of your Personal Data, You have the right to demand compensation for damages in case your Personal Data is processed unlawfully and causes you harm.

Arta Textile Industry and Trade Limited Company will fulfill your request as soon as possible and at the latest within the legal period, free of charge, depending on the nature of the request. If there is a cost due to the fulfillment of your requests, we may request fees specified by the Personal Data Protection Board.
